Consumer Health Data Privacy Policy

Overview

This policy describes how Team Red, White & Blue (“Team RWB,” “we,” “our,” or “us”) collects, uses, shares, and protects consumer health data when you use our mobile application (the “App”) and connect wearable devices or fitness platforms to the App.

This Consumer Health Data Privacy Policy supplements our general Privacy Policy and applies specifically to “consumer health data” as defined by applicable consumer health privacy laws, including health, fitness, and activity data collected through the App’s activity tracking and wearable integration features. If there is a conflict between this policy and our general Privacy Policy regarding consumer health data, this policy controls with respect to consumer health data.

Team RWB is a 501(c)(3) nonprofit organization dedicated to enriching the lives of America’s veterans. Your health and activity data is used solely to power your experience within the App and to support our mission.

What Consumer Health Data We Collect

When you connect a wearable device or fitness platform to the App, we may collect the following categories of health and activity data:

  • Heart rate data: such as your average heart rate during workouts

  • GPS route and location data: such as the route of an outdoor workout

  • Steps, distance, and elevation data

  • Calories burned and active time

  • Workout metrics: such as pace, cadence, power, speed, and duration

  • Activity summaries: such as daily, weekly, and annual activity summaries

  • Workout and exercise session data: such as activity type, start time, and duration

Note: The specific data collected depends on your connected wearable device or fitness platform and the permissions you grant. Not all data types are available from all platforms.

How We Use Consumer Health Data

We primarily collect and use consumer health data as necessary to provide you with products or services that you request or for other purposes for which we obtain your consent as required by applicable law. This may include the following:

  • providing you with the App and its associated services;

  • communicating with you and providing support, such as to provide you information about the App, address your inquiries and feedback, requests, and other communications you send us, and provide you with customer support services;

  • operating, evaluating, and improving our business, such as to perform accounting, auditing, record keeping, and other internal functions, conducting research, developing new products and services, analyzing and improving our App, and personalizing your experience;

  • complying with law, such as to comply with legal obligations and process and contractual obligations, as well as our policies and terms and conditions; and 

  • any other lawful purpose for which we obtain your consent.

We may also collect and use consumer health data as necessary to protect the rights and safety of us, our affiliates, you, or others, such as to:

  • prevent, detect, protect against, or respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or any activity that is illegal under applicable state law or federal law; 

  • preserve the integrity or security of our systems; and

  • investigate, report, or prosecute those responsible for any such action that is illegal under applicable state law or federal law.

We may deidentify consumer health data so that it cannot reasonably be reidentified by us or by another person, and we may use this deidentified data for any reason permitted by applicable law. If we deidentify information that was originally based on consumer health data, we maintain and use that information in deidentified form and will not attempt to reidentify the data, except as otherwise permitted or required under applicable law.

Sources of Consumer Health Data

We collect consumer health data from the following sources:

  • Directly from you, when you manually log workouts or activity in the App.

  • From third-party wearable devices and fitness platforms that you choose to connect to the App, including:

    • Apple Health (via HealthKit)

    • Google Health Connect

    • Strava

    • Samsung Health

    • Other wearable platforms connected through Terra, a third-party data aggregation service

Two steps are required before we collect any health data. First, you must accept our in-app consent screen. Second, you must authorize the connection on the third-party platform’s own authorization page. We do not collect health data until both steps are completed.

How We Share Consumer Health Data

We share your consumer health data for the purposes outlined above only in the following limited circumstances:

  • Service providers and processors. We share health data with service providers that help us operate the App, including Terra (a data aggregation service that facilitates connections between wearable platforms and the App) and our infrastructure and hosting providers. These service providers are contractually required to use your data only to provide services to us.

  • Other App members. Your workout data is private by default. Other members can see your workout data only if you choose to share it to the App feed. GPS route and map data is shared only if you separately opt in using the Share workout map toggle, which is turned off by default.

  • Challenge and leaderboard participants. If you join a fitness challenge, your activity data related to that challenge will be visible to other challenge participants on the leaderboard.

  • Research partners. We may share limited, aggregated, or de-identified health data with research partners to support research initiatives benefitting military members, veterans, and their family members.

  • Legal requirements. We may disclose health data when required by law, in response to a valid legal process, or to protect the rights, safety, or property of Team RWB, our members, or the public.

How to Exercise Your Rights

Under applicable consumer health privacy laws, subject to certain exceptions, you may have the right to access or delete consumer health data about you, or receive a list of third parties and affiliates with whom your consumer health data was shared.  You also may have the right, subject to certain exceptions, to withdraw consent relating to the use and sharing of your consumer health data. To exercise these rights, you may email us at info@teamrwb.org. We will use information you provide in your request to verify your identity, and we may request additional information if necessary to complete the verification process.

If your request to exercise a right under applicable law is denied, you may appeal that decision by contacting us as described below. If your appeal is unsuccessful, you can lodge a complaint with the respective state Attorney General.

Supplement to Consumer Health Data Privacy Policy for Connecticut and Nevada Consumers

This supplement applies only with respect to Connecticut and Nevada consumers and provides additional disclosures required by these consumer health privacy laws. 

  • Requesting Changes to Consumer Health Data. You may request a change to your consumer health data by emailing us at info@teamrwb.org. We will use information you provide in your request to verify your identity, and we may request additional information if necessary to complete the verification process. 

  • Third Party Collection of Consumer Health Data. Third parties do not collect consumer health data over time and across different online services when you use our App. 

  • Changes to this Consumer Health Data Privacy Policy. We may modify or update this Consumer Health Data Privacy Policy from time to time. We encourage you to visit this Consumer Health Data Privacy Policy regularly to learn about any changes to the way we collect, use, or share your consumer health data. If we make a material change to this Consumer Health Data Privacy Policy, we will take reasonable steps to notify you as required by applicable law.
